This Privacy Policy describes how MyRecruiter LLC ("Company," "we," "us," or "our") collects, uses, discloses, and safeguards information when you visit or use our website, chat widget, connected messaging channels, and related services (collectively, the "Service"). It also explains your privacy rights and how the law protects you.

By accessing or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

Words with capitalized initial letters have meanings defined below. These definitions apply whether the terms appear in singular or plural form.

Definitions

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party.
  • AI or Artificial Intelligence means automated systems, including large language models, used to generate responses, summaries, and other outputs within the Service.
  • Company refers to MyRecruiter LLC.
  • Cookies are small files placed on your device to store information about your browsing activity.
  • Country refers to the United States.
  • Customer means an organization (such as a nonprofit) that licenses the Service and deploys it to interact with its own audience through our chat widget, forms, and connected messaging channels.
  • Data Controller means the party that determines the purposes and means of processing Personal Data.
  • Device means any device that can access the Service, such as a computer, smartphone, or tablet.
  • End User means an individual who interacts with a Customer through the Service — for example, a visitor who uses a Customer's chatbot or messages a Customer through Facebook Messenger or Instagram.
  • Messaging Channels means third-party messaging platforms a Customer connects to the Service, currently Facebook Messenger and Instagram.
  • Meta Platform Data means information we obtain from or through Meta Platforms, Inc. ("Meta") in connection with the Messaging Channels, including platform-assigned user identifiers and message content.
  • Personal Data means any information that identifies, relates to, describes, or could reasonably be linked to an identified or identifiable individual.
  • Processor (or Service Provider) means a party that processes Personal Data on behalf of, and under the instructions of, a Data Controller.
  • Sensitive Personal Information means Personal Data revealing categories such as precise geolocation, racial or ethnic origin, health, or the contents of certain communications, as defined by applicable law.
  • Service refers to the MyRecruiter website, chat widget, connected Messaging Channels, forms, analytics, and related services.
  • Usage Data means data collected automatically through the use of the Service.
  • Website refers to MyRecruiter, accessible at https://www.myrecruiter.ai.
  • You means the individual or entity accessing or using the Service.

Our Two Roles: When We Are a Processor and When We Are a Controller

MyRecruiter operates in two distinct roles, and your rights depend on which applies.

When we act as a Processor (Service Provider). In most End User interactions, MyRecruiter processes Personal Data on behalf of a Customer. For example, when you use a nonprofit's chatbot, submit a form, or message that nonprofit through Facebook Messenger or Instagram, the Customer is the Data Controller and MyRecruiter is a Processor acting on the Customer's instructions and under our agreement with them. In these cases:

  • The Customer determines what data is collected and why.
  • We process End User data only to provide the Service to that Customer and as permitted by our agreement and applicable law.
  • Data submitted through a Customer's implementation belongs to the Customer.
  • If you are an End User and wish to exercise privacy rights over that data, you may contact us and we will assist and route your request, but the Customer (as Controller) directs how it is handled. We will refer you to the relevant Customer where appropriate.

When we act as a Controller. When you interact directly with MyRecruiter's own website, marketing, sales, or account functions (for example, requesting a demo, corresponding with us, or administering a Customer account), MyRecruiter is the Data Controller for that information.

Information We Collect

Information You Provide Directly

  • Contact and identity information — first and last name, email address, phone number, and mailing address (city, state, ZIP/postal code).
  • Form and submission content — information you enter into forms presented through the Service, including free-text answers you choose to provide.
  • Account information — for Customer administrators, credentials and profile information managed through our authentication provider.
  • Communications — the content of messages, support requests, and other communications you send us.

Conversation and Message Content

The Service is built around interactive conversations. When you use a chatbot or message a Customer through a Messaging Channel, we collect and process:

  • The content of the messages you send, including text and any selections you make from buttons or menus.
  • Conversation context and identifiers, such as session and conversation identifiers used to maintain a coherent exchange.
  • AI-generated content derived from the conversation, such as summaries (see "Artificial Intelligence and Automated Processing").

Please avoid submitting information you do not wish to share. Because conversations are open-ended, they may contain Personal Data you choose to include.

Messaging Channel Data (Facebook Messenger and Instagram)

When a Customer connects Facebook Messenger or Instagram and you message that Customer, we receive from Meta:

  • A platform-assigned user identifier (a Meta Page-Scoped ID or Instagram-Scoped ID). This is a pseudonymous identifier specific to the Customer's Page or account; it is not your Facebook or Instagram profile, name, or contact details.
  • The content of the messages you send, including postback (button/menu) selections.
  • Message metadata, such as message identifiers and timestamps, used to process and de-duplicate your messages.

We do not request or receive your Facebook or Instagram profile, friend list, or public content through this integration. See "Messaging Channels — Facebook Messenger and Instagram" for how this data is handled and "Your Privacy Rights and Choices" for deletion.

Usage Data

Usage Data is collected automatically and may include:

  • IP address (used transiently for delivery and security)
  • Browser type and version
  • Pages visited and time spent on pages
  • Device identifiers
  • Diagnostic and performance data

When accessing the Service via a mobile device, additional information such as device type, operating system, and mobile browser type may be collected.

Cookies and Tracking Technologies

We use Cookies and similar technologies to operate and improve the Service.

You can control cookie preferences through your browser settings. Refusing cookies may limit certain features of the Service.

How We Use Personal Data

We use Personal Data to:

  • Provide, operate, and maintain the Service, including generating responses to your messages;
  • Manage user accounts and registrations;
  • Perform contractual obligations to our Customers;
  • Communicate with you via email, SMS, or other electronic means, including service-related notices and support;
  • Provide updates and, where permitted, relevant information about our products and services (you may opt out);
  • Analyze usage trends and improve the Service, using de-identified or aggregated data where practicable;
  • Ensure security, prevent fraud and abuse, and enforce our policies; and
  • Support business transfers such as mergers or acquisitions.

Where we act as a Processor, we use End User data only to provide the Service on the Customer's behalf and per the Customer's instructions.

Artificial Intelligence and Automated Processing

The Service uses automated systems and Artificial Intelligence to generate responses, analyze interactions, and improve functionality.

  • How it works. To generate a reply, the content of your messages (from the chat widget or a connected Messaging Channel) is processed by our cloud AI service provider — Amazon Web Services (Amazon Bedrock), using Anthropic's Claude models — together with a Customer's configured knowledge base. The generated reply is returned to you through the Service.
  • AI-generated content about individuals. The Service may generate and store limited derived content about a conversation, such as conversation summaries, to maintain context and support the Customer. We do not use AI to make legal, employment, credit, or similar decisions that produce legal or similarly significant effects about you.
  • No training on your data. We do not use Customer or End User data to train public or shared AI models, and our AI service provider does not use data submitted through the Service to train its models.
  • Human involvement. Customers may review conversations and follow up with you through the Service.

Messaging Channels — Facebook Messenger and Instagram

Our Customers may connect their Facebook Page or Instagram professional account to the Service so that messages sent to them through Facebook Messenger or Instagram are answered automatically on their behalf.

What we receive and how we use it. When you message a Customer through these channels, we receive the data described in "Messaging Channel Data" above (a platform-assigned user ID, your message content, and message metadata). We use it solely to generate and deliver a response on behalf of the Customer you contacted, using the AI systems described in "Artificial Intelligence and Automated Processing." Message content is processed by our AI service provider to produce a reply, which is then delivered back to you through Meta's platform.

Compliance with Meta terms. Your use of Facebook Messenger and Instagram is also governed by Meta's own Privacy Policy and terms. We handle Meta Platform Data in accordance with the Meta Platform Terms and Developer Policies. Specifically:

  • We use Meta Platform Data only to provide and improve the Service's messaging functionality for the connecting Customer.
  • We do not sell, license, or rent Meta Platform Data, and we do not use it for advertising, to build or augment profiles for advertising, or for any purpose prohibited by Meta.
  • We retain Meta Platform Data only as long as needed to provide the Service, and we delete it as described in "Retention of Your Personal Data" (or upon a valid deletion request).
  • We maintain administrative, technical, and physical safeguards for Meta Platform Data consistent with "Security of Your Personal Data."

Requesting deletion of messaging data. See "Deletion of Messaging Channel Data" under "Your Privacy Rights and Choices" for how to request deletion of data associated with your Messenger or Instagram conversations.

SMS and Electronic Communications

If you provide a phone number, you may receive SMS messages related to the Service. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP or following the instructions provided in the message; reply HELP for help. Where required, we record your consent to receive messages, including the time and the language of the consent shown to you. SMS opt-in consent is not shared with third parties for their own marketing.

How We Share and Disclose Personal Data

We do not sell your Personal Data. We share Personal Data only as described here:

  • With our Customers, who are the Controllers of End User data collected through their implementations.
  • With Subprocessors that support hosting, communications, AI processing, and infrastructure (see the table below).
  • Through Meta's platform, to deliver responses to you when you use a Messaging Channel.
  • With Affiliates under common control, consistent with this Policy.
  • For business transfers, such as a merger, acquisition, or sale of assets.
  • With your consent, for specific purposes you authorize.
  • For legal obligations or protection of rights, safety, and property, and to investigate wrongdoing or security issues.

Where a Customer directs data to a downstream destination it controls (for example, its own CRM, spreadsheet, email, or webhook endpoint), that transfer is made at the Customer's direction and under the Customer's own privacy practices; such destinations are not our Subprocessors.

Subprocessors

We engage the following categories of Subprocessors to operate the Service. Personal Data is shared with them only as needed to provide the Service.

A current list of Subprocessors is available on request. We remain responsible for our Subprocessors' handling of Personal Data as required by applicable law and our agreements.

Retention of Your Personal Data

We retain Personal Data only as long as necessary to fulfill the purposes described in this Policy, provide the Service to our Customers, comply with legal obligations, resolve disputes, and enforce agreements.

  • Conversation and message content is retained for a limited period to maintain conversation context and then deleted or aged out automatically. Messaging Channel (Messenger/Instagram) message content is retained on a short-term basis for context and then deleted.
  • Form and submission content is retained for a limited period — typically no longer than 12 months — and then deleted automatically. Where a Customer configures a shorter retention period for the data it collects, that shorter period applies.
  • Analytics and diagnostic data is retained on a limited, generally short-term basis, in de-identified or truncated form where practicable.
  • Operational logs are retained for a limited period for security and troubleshooting.

Where we delete Personal Data, residual copies may persist for a limited additional period in encrypted backups and point-in-time recovery snapshots before they expire. Customers may specify retention settings that apply to their data.

Security of Your Personal Data

We use commercially reasonable administrative, technical, and physical safeguards to protect Personal Data, including encryption in transit and at rest, access controls, tenant isolation, and encryption of sensitive credentials with managed keys. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your Privacy Rights and Choices

Depending on where you live and our role (Controller or Processor), you may have the rights below. Where MyRecruiter acts as a Processor for a Customer, we will assist the Customer in fulfilling your request or refer you to the Customer as the Controller.

General Rights

You may request to:

  • Access or receive a copy of your Personal Data;
  • Correct inaccurate Personal Data;
  • Delete your Personal Data;
  • Opt out of marketing communications; and
  • Withdraw consent where processing is based on consent.

We will not discriminate against you for exercising these rights.

How to Make a Request

Contact us at privacy@myrecruiter.ai. We will verify your request as required by law before acting on it. You may use an authorized agent where permitted.

Deletion of Messaging Channel Data (Messenger/Instagram)

To request deletion of data associated with your Messenger or Instagram conversations, contact us at privacy@myrecruiter.ai. Because these channels identify you only by a platform-assigned ID (not your name or email), please include enough detail — such as the organization you contacted and the approximate date — for us to locate your messages. If we cannot reasonably associate a request with stored data (for example, where no identifying detail is provided), we may be unable to complete the request. Messaging Channel content also ages out automatically as described in "Retention of Your Personal Data."

California Residents (CCPA/CPRA)

If you are a California resident, you have the right to know, access, correct, and delete your Personal Information, to opt out of "sale" or "sharing" of Personal Information, and to limit use of Sensitive Personal Information. We do not sell your Personal Information, and we do not "share" it for cross-context behavioral advertising. We do not knowingly sell or share the Personal Information of individuals under 16.

  • Categories of Personal Information we collect: identifiers (name, email, phone, address, online/platform identifiers); commercial/inquiry information; internet or network activity (usage data); geolocation (coarse, from IP); and the contents of communications you send through the Service.
  • Purposes: as described in "How We Use Personal Data."
  • Sources and disclosures: as described in "Information We Collect" and "How We Share and Disclose Personal Data."

To exercise these rights, contact us as described in "How to Make a Request." You may designate an authorized agent.

Other U.S. State Privacy Rights

If you reside in a state with a comprehensive privacy law (such as Virginia, Colorado, Connecticut, Utah, Texas, or others), you may have rights to access, correct, delete, obtain a portable copy of, and opt out of targeted advertising, sale, or certain profiling of your Personal Data. We do not sell Personal Data or use it for targeted advertising. Submit requests as described in "How to Make a Request"; you may appeal a denied request by replying to our response.

EEA/UK Individuals

Our Service is directed to the United States. If you are located in the European Economic Area or the United Kingdom and interact with the Service, you may have rights to access, rectify, erase, restrict, and object to processing, and to data portability, under applicable law. Where we act as a Processor, the connecting Customer is the Controller and directs these requests.

Children's and Minors' Privacy

The Service is intended for adults. Information submitted through the Service — including volunteer inquiries and family referrals — is provided by adults, such as a parent or guardian; minors do not interact with the Service. We do not direct the Service to children and do not knowingly collect Personal Data from children under 13. If we learn that we have collected Personal Data from a child under 13, we will delete it promptly. If you believe a child has provided Personal Data, contact us at privacy@myrecruiter.ai.

International Data Transfers

Your information may be processed and stored in the United States or other locations where we or our Subprocessors operate. By using the Service, you consent to such transfers. Where required, we take reasonable steps to ensure appropriate safeguards are in place.

Links to Other Websites

Our Service may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites and encourage you to review their privacy policies.

Changes to This Privacy Policy

We may update this Privacy Policy periodically. Changes will be posted on this page and the "Last updated" date revised. Material changes will be communicated as required by law. Continued use of the Service after an update constitutes acceptance of the updated Policy.
