Terms of Service

These Terms of Service ("Terms") govern access to and use of the MyRecruiter website, products, and services (collectively, the "Service") operated by MyRecruiter LLC, a Delaware limited liability company ("Company," "we," "us," or "our"). Please read them carefully.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. The Service

MyRecruiter provides an AI-powered engagement platform designed to help nonprofit and mission-driven organizations engage their audiences, answer questions, and collect information such as inquiries, volunteer interest, and form submissions. Depending on configuration, the Service may include:

  • An embeddable AI chat widget that generates automated responses;
  • Connected messaging channels, currently Facebook Messenger and Instagram, that answer messages on a Customer's behalf;
  • Conversational forms and data collection;
  • Analytics dashboards;
  • Optional features such as SMS/email follow-up and appointment scheduling; and
  • Integrations with third-party services.

The Service relies on automated systems and artificial intelligence to generate responses and insights (see Section 7).

2. Who These Terms Cover

The Service is used by two kinds of people, and these Terms apply differently to each:

  • Customers — organizations that license the Service and deploy it to interact with their own audiences (for example, a nonprofit that adds our chat widget to its website or connects its Facebook Page). Customers, and the individuals who administer a Customer account, are bound by all of these Terms.
  • End Users — individuals who interact with a Customer through the Service, such as a website visitor who uses a Customer's chatbot or a person who messages a Customer through Facebook Messenger or Instagram. End Users' relationship is primarily with the Customer they contact; the Customer's own terms and privacy notices govern that interaction. When you use the Service in this way, the acceptable-use rules in Section 5 still apply to you.

How we handle personal information for each role is described in our Privacy Policy, which is incorporated into these Terms by reference.

3. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organization you represent. By using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

4. Accounts

To access certain features, a Customer administrator may be required to create an account, managed through our authentication provider.

You agree to:

  • Provide accurate and complete information;
  • Keep your login credentials secure;
  • Notify us promptly of any unauthorized access.

You are responsible for all activity that occurs under your account.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation;
  • Collect or process data without proper authorization, notice, or consent;
  • Transmit malicious code, spam, or abusive, harassing, or unlawful content;
  • Infringe upon intellectual property or privacy rights;
  • Attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying systems; or
  • Use the Service, or any AI output, in a way that is deceptive or that misrepresents automated responses as something other than what they are.

We reserve the right to suspend or terminate access for violations of this section.

6. Customer Responsibilities

As explained in our Privacy Policy, when MyRecruiter processes data collected through a Customer's implementation, the Customer is the data controller and MyRecruiter is a processor acting on the Customer's instructions. As a Customer, you are responsible for your own use of the Service, including:

  • Lawful basis and notice. Having an appropriate legal basis, and providing any required privacy notices and obtaining any required consents, for the data you collect from your End Users through the Service.
  • Your configuration and content. The chatbot behavior, forms, knowledge-base content, and other materials you configure, and the accuracy and lawfulness of that content.
  • Messaging and outreach compliance. If you enable SMS, email, or messaging follow-up, complying with applicable communications laws (including consent, opt-out, and record-keeping requirements) for the messages you send to your audience.
  • Connected accounts. Having the authority to connect any Facebook Page, Instagram professional account, or other third-party account you link to the Service, and complying with the terms of those platforms (see Section 8).
  • Downstream destinations. Any destination you direct data to — such as your own CRM, spreadsheet, email, or webhook endpoint — which operates under your own agreements and privacy practices, not ours.
  • Program compliance. Complying with the laws applicable to your programs and audiences. The Service is a general-purpose engagement tool; it is not designed or licensed for making employment, hiring, credit, insurance, tenancy, or similar decisions, or for evaluating background-check or consumer-report information. If you intend to use the Service in any such context, you are responsible for obtaining appropriate legal review and complying with all applicable laws (such as the FCRA and equal-opportunity laws) first.
  • End-user notices. Where appropriate for your audience and configuration, informing your End Users that they are interacting with an automated/AI system and, for sensitive topics, that the Service is not an emergency or crisis service.

7. Customer Data and Ownership

Customer Content

You retain ownership of all data, content, and information submitted to the Service by you or your End Users ("Customer Data"). You grant MyRecruiter a limited, non-exclusive right to process Customer Data solely to provide, secure, and maintain the Service.

Our Role

When processing Customer Data collected through a Customer's implementation, MyRecruiter acts as a service provider / data processor, and the Customer remains the data controller, as described in the Privacy Policy. We do not sell Customer Data, and we do not use Customer Data for cross-context behavioral advertising.

8. Artificial Intelligence and Automated Processing

The Service uses automated systems and artificial intelligence to generate responses, produce conversation summaries, and provide insights. To generate a reply, the content of a conversation is processed by our cloud AI provider (Amazon Web Services' Amazon Bedrock, using Anthropic's Claude models) together with a Customer's configured knowledge base.

You acknowledge that:

  • AI-generated responses may be inaccurate, incomplete, or otherwise erroneous, and should not be relied upon as professional, legal, medical, financial, or other specialized advice;
  • The Service is intended to assist, not replace, human judgment, and Customers are responsible for reviewing and configuring outputs for their use case;
  • The Service is not intended to make legal, employment, credit, or similarly significant automated decisions about individuals.

We do not use Customer Data or End User data to train public or shared AI models. Under our current configuration and our AI providers' terms, data submitted through the Service is not used to train their models.

Not an emergency service. The Service does not provide crisis, medical, mental-health, legal, or safety advice and is not a substitute for professional judgment or emergency services. If you or someone else may be in danger or in crisis, contact emergency services or an appropriate hotline.

9. Messaging Channels (Facebook Messenger and Instagram)

A Customer may connect its Facebook Page or Instagram professional account so that messages sent to it through Facebook Messenger or Instagram are answered automatically on its behalf. If you connect such an account, you represent that you are authorized to do so, and your use of those channels is also governed by Meta's own terms and policies.

We handle data obtained through these channels ("Meta Platform Data") in accordance with the Meta Platform Terms and Developer Policies and as described in our Privacy Policy — using it only to provide and improve the messaging functionality for the connecting Customer, and not selling it or using it for advertising. Meta is not a party to these Terms and is not responsible for the Service.

10. Third-Party Services

The Service integrates with or relies on third-party services (for example, cloud hosting and AI processing, messaging platforms, scheduling, and payment processing). We are not responsible for third-party services and do not guarantee their availability, performance, or accuracy. Your use of third-party services may be subject to separate terms imposed by those providers.

11. Fees and Payments

Paid features of the Service are offered on a subscription basis. Unless otherwise stated in the plan details shown at checkout:

  • Subscription fees are billed in advance on a recurring monthly or annual basis through our payment processor;
  • Subscriptions renew automatically for successive periods unless cancelled before the start of the next period;
  • Fees are non-refundable except as required by law;
  • You are responsible for applicable taxes; and
  • We may change pricing with reasonable advance notice, effective as of your next renewal.

Failure to pay may result in suspension or termination of access. You may cancel a subscription at any time from your account or billing portal; cancellation stops the next renewal and takes effect at the end of the then-current billing period.

12. Availability and Modifications

We strive to provide a reliable Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue parts of the Service at any time, with or without notice.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if:

  • You violate these Terms;
  • Payment obligations are not met; or
  • Continued use poses legal, security, or operational risk.

Upon termination, access to the Service will cease, and Customer Data will be handled and deleted in accordance with our data retention practices described in the Privacy Policy. You may export or request a copy of your Customer Data before termination; after termination, we may make it available for a limited period before it is deleted. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

14. Intellectual Property

The Service, including its software, design, branding, and content (excluding Customer Data), is the exclusive property of MyRecruiter LLC. You may not copy, modify, distribute, or reverse engineer the Service without prior written consent.

15. Disclaimers

The Service is provided "as is" and "as available."

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service, or any AI-generated output, will meet your requirements, be uninterrupted, or be accurate or error-free.

16. Limitation of Liability

To the maximum extent permitted by law:

  • MyRecruiter shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data;
  • Total liability shall not exceed the amount paid by you to MyRecruiter in the 12 months preceding the claim.

17. Indemnification

You agree to indemnify and hold harmless MyRecruiter LLC from any claims, damages, losses, or expenses arising from:

  • Your use of the Service;
  • Your Customer Data or the configuration and content you deploy through the Service;
  • Your relationships and communications with your End Users;
  • Your violation of these Terms; or
  • Your violation of applicable laws or third-party rights.

18. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

19. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised "Last updated" date. We will provide reasonable advance notice of material changes to active Customers (for example, by email to the account address); where a material change affects a paid subscription, you may cancel before it takes effect at your next renewal. Continued use of the Service after an update constitutes acceptance of the updated Terms.

20. General

Entire agreement. These Terms, together with the Privacy Policy and the plan details shown at checkout, are the entire agreement between you and MyRecruiter regarding the Service and supersede all prior or contemporaneous representations, proposals, or agreements.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, outages or failures of third-party providers or networks, labor disputes, or governmental action.

Notices. We may provide notices to you by email to your account address or by posting within the Service. You may send notices to us at info@myrecruiter.ai.

Severability. If any provision of these Terms is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
